Network Partner Agreement

Overview

This Partner Agreement ("Agreement") governs your participation as a partner or member of the On Target Network. By joining the Network — whether through a form submission, community channel membership, or verbal agreement — you acknowledge and agree to the following terms.

1. Nature of the Relationship

Participation in the On Target Network does not create an employment, agency, partnership, franchise, or joint venture relationship between you and On Target Network or any of its member companies. You are an independent professional engaging with the Network for co-marketing and referral coordination purposes.

2. License Requirement for Agents

If you are participating as a real estate agent, you represent and warrant that you hold a valid, active real estate license in the State of Florida and that you are affiliated with a licensed Florida real estate brokerage. You agree to notify the Network immediately if your license status changes.

3. Commission Terms

Any commission discussed in connection with Network deals is subject to the terms of the individual purchase and sale agreement and MLS rules applicable to that transaction. Commission rates are not guaranteed. On Target Network does not directly pay commissions — compensation is paid by the applicable licensed member company.

3a. Payment Routing

Commission compensation for the "Bring a Buyer" and "Listing Conversion" paths under One Ten West Development will be paid to your licensed brokerage of record, or directly to you only upon written direction from your broker as permitted under Florida law. Referral compensation from Green Planet Steel, Evolution Power, or the One Ten West "Pure Referral" path is not compensation for a licensed real estate service and may be paid directly to you regardless of brokerage affiliation.

4. RESPA and Anti-Kickback Acknowledgment

You acknowledge that referrals between Network member companies are governed by the Real Estate Settlement Procedures Act (RESPA). You agree not to give or receive any fee, kickback, or thing of value in exchange for referrals of settlement service business in violation of RESPA Section 8. You acknowledge receipt of the On Target Network Affiliated Business Arrangement Disclosure.

4a. Mortgage and Title Referrals

You acknowledge that no fee, commission, or thing of value is paid to you for referring mortgage or title business to On Target Mortgage, LLC or On Target Title, LLC, unless you (a) hold a bona fide ownership interest in the applicable company and receive only proportional ownership distributions unrelated to any specific referral, or (b) are party to a written marketing services agreement compensating you for actual marketing services rendered, unrelated to referral volume or loan/closing amounts.

5. Confidentiality

Deal information, lead details, pricing, and other information shared within Network community channels is confidential. You agree not to share Network deal flow or partner information with parties outside the Network without prior consent.

6. No Guarantee of Outcomes

On Target Network makes no guarantee of deal volume, commission income, investment returns, or business results of any kind. Your results will depend on your individual effort, market conditions, and transaction-specific factors.

7. Termination

Either party may discontinue participation in the Network at any time without cause. Termination does not affect obligations arising from transactions already in progress.

8. Governing Law

This Agreement is governed by the laws of the State of Florida. Disputes shall be resolved in Orange County, Florida.
